Stockr Terms of Service
These terms and conditions set forth the terms and conditions of use of the service "Stockr" (the "Service") provided by Build It Inc. The privacy and freedom of expression of personal information, posted data, and freedom of expression of users of the Service ("Users") are respected to the fullest extent, but Users are deemed to have agreed to these Terms and Conditions when they begin to use the Service.
Article 1: Purpose
The purpose of this Agreement is to define the terms and conditions of the Service and the rights and obligations between the Operator of the Service (hereinafter referred to as "the Operator") and the User, and it shall apply to all relationships between the User and the Operator.
Article 2: Appropriate Management of User ID and Password
Users shall properly manage and store their user IDs and passwords for the Service at their own risk. Users shall not, under any circumstances, transfer or lend their authority to use their accounts to any third party.
The Operator shall not be responsible for any damage or disadvantage caused by inadequate management of the password or user ID, etc., or by the use of a third party, etc., and the user shall be held responsible for such damage or disadvantage.
Article 3: Prohibited Items
A user shall not engage in any of the following acts in the use of this service. The Operator shall have the right to delete or hide the relevant contents, as well as suspend or delete the user's account, if any of the following acts are found to have occurred
- Actions that are against the law or public order and morals.
- Acts related to a criminal act.
- An act to destroy or interfere with the functions of the operator's server or network.
- Any action that interferes or may interfere with the operation of the Service.
- Collecting or accumulating the personal information of others.
- Pretending to be someone else.
- Any act that directly or indirectly provides benefits to antisocial forces.
- Any action that infringes on the intellectual property rights, rights of publicity, privacy, honor, or any other rights or interests of the User, the Operator or any third party.
- Accessing the paid contents on the service without payment through some means.
- An act of describing false information that may deceive other users or third parties.
- Actions that are considered as spam (e.g., posting automatically generated sentences by a machine, or repeatedly posting the same content).
- Posting of inappropriate contents such as excessively violent expressions, explicit sexual expressions, expressions that lead to discrimination based on race, nationality, creed, gender, social status, etc., expressions that invite or encourage suicide, self-injury, or drug abuse, or expressions that are offensive to others.
- Acts for the purpose of sexual intercourse or indecent acts, acts for the purpose of meeting or dating unacquainted members of the opposite sex, harassment or slander of others.
- Religious activities or solicitation for religious organizations.
- Any other actions that the operator deems inappropriate.
Article 4: Suspension or interruption of the Service
The Operator shall be entitled to suspend or terminate the Service, in whole or in part, without prior notice to the User, if the Operator determines that any of the following reasons exist The Operator shall not be liable for any damage or disadvantage incurred by the User or a third party due to the suspension or interruption of the Service.
- When performing maintenance, inspection, or update of the system related to the Service.
- In the event of difficulty in providing the Service due to force majeure or accidents such as earthquakes, lightning, fire, power outages or natural disasters.
- In the event that the cloud service used by the Service stops.
- Other cases in which the Operator deems it difficult to provide the Service.
Article 5: Copyright
Users may only use, post and edit information such as text, images, etc. for which they own the necessary intellectual property rights, such as copyrights, or for which they have obtained permission from the necessary right holders.
The copyright of any text, images, etc. posted or edited by a user using the Service is retained by the user or the existing right holder.
Users or third parties may not reprint or redistribute the contents on the Service without permission of the right holder.
Article 6: Data Analysis and Utilization
The Operator shall be able to analyze user information, behavioral history, posted data, etc. in the Service using statistical processing, machine learning, and other methods in order to improve the service to Users.
Article 7: Advertisement
The Operator reserves the right to place third party advertisements on the Service.
Article 8: Withdrawal from the Service
A user may delete his or her registered account at any time (cancellation of membership). In the event that a user violates this agreement, the operator may delete the data related to the account and cancel the registration without prior notice. The Operator shall not be liable for any damage or disadvantage incurred by the user as a result of withdrawal from the membership or cancellation of the registration.
Article 9: Disclaimers of warranties and exemption from liability
The Operator does not warrant, either explicitly or implicitly, that the service is free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.) No warranty, either express or implied, is given that the Service is free of defects (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other defects, errors, bugs, or infringement of rights). The Operator shall not be liable for any transactions, communications, or disputes between a user and other users or third parties in relation to this service.
Article 10: Changes and Suspension of the Service
The Operator may change the contents of the Service or suspend some functions of the Service without prior notice to users, and shall not be liable for any damage or disadvantage caused to users as a result of such changes. In addition, the Operator shall not be liable for any damage or disadvantage caused to the user due to the termination of the Service.
Article 11: Changes to the Terms of Service
The Operator shall be able to amend this Agreement at any time without notice to the user if it is deemed necessary.
Article 12: Governing Law and Jurisdiction
The interpretation of this agreement shall be governed by the laws of Japan. All disputes arising in connection with this service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
